Expte. Nº45/2016 Partido: LOS JUVENILES vs LOS CANARIOS (1º FEM), de fecha 01/10/16

VISTO: los informes de los árbitros de los partidos de fecha 01/10/2016.

RESUELVE:

1) Dar por perdido el partido al Club Los Canarios y ganado al Club Los Juveniles. Registrar en tabla de posiciones el siguiente resultado: Los Juveniles 1 – Los Canarios 0. (cfr. arts. 109 y 152 del RTP).

2) Sancionar al Club Los Canarios con una multa de 225 VE a $50 c/u. (cfr. art. 109 del RTP)

3) Archívese y publíquese.

Expe. Nº44/2016 Protesta de partido: NACIONAL vs INDEPENDIETE (3ºB), de fecha 17/09/2016 VISTO: la protesta presentada por el Club Nacional, mediante nota protesta el partido que disputó esa institución frente al Club Independiente, el día 17/09/16, en su estadio, y que finalizó con el resultado de 3 goles a 1 a favor del Club Independiente. En este partido participaron con el dorsal número 12 el futbolista Dante Viñas, y con el dorsal número 5 el futbolista Omar Solari, ambos jugadores exceden el límite edad para participar en la división reserva de la Liga Santafesina. Se ha adjuntado la copia de la correspondiente planilla de firmas del encuentro, y solicitan que de la tabla de posiciones le quiten las tres unidades al Club Independiente y le asignen 3 al Club Nacional. CONSIDERANDO: Que luce agregada la planilla del encuentro del partido cuestionado, en donde se observa los nombres de los jugadores Dante Viñas y Omar Solari en los casilleros Nº 12 y 5 respectivamente del Club Independiente; se encuentra agregado el recibo por el cual el peticionante protesta el encuentro. Se observa que ambos jugadores son mayores a la edad permitida par participar en división reserva. Corrido que fue el traslado al Club Independiente, el cual presenta un escrito, a efectos de formular las defensas que hacen a su derecho, y en dicho escrito reconocen el error cometido. Por todo lo expuesto este Tribunal

RESUELVE:

1) Dar curso a la protesta del Club Nacional, debido a que los señores Dante Viñas y Omar Solario se encuentran inhabilitado para participar en partidos de división reserva de la Liga Santafesina de Fútbol.

2) Se da por perdido este partido al Club Independiente, registrándose el resultado de Nacional (1), Independiente (0). (cfr. art. 107 del RTP). Registrar en tabla de posiciones por este partido: 3 unidades al Club Nacional y ninguna al Club Independiente.

3) Se multa al Club Independiente en V. E. 75. (cfr. art. 21 y 91 del RTP)

4) Se dispone la devolución del importe abonado por derecho de protesta, al Club Nacional (cfr. art. 21 del RTP)

5) Archívese y publíquese.

Expte. Nº43/2016 Partido: INDEPENDIENTE vs DON SALVADOR (6º Y 5º), de fecha 25/09/16 VISTO: El escrito presentado por el señor Manuel Esquivel, en donde niega que los hechos sucedidos e informados por el árbitro sean reales. CONSIDERANDO: Que el escrito presentado por la parte imputada, corresponde señalar, que las razones expuestas en el mismo no logran conmover los motivos tenidos en cuenta por este H.T.P., entre los cuales, cabe destacar que los informes arbítrales confeccionados constituyen semiplena prueba de lo que en ellos consignan y que solo mediante pruebas directas en contrario puede desacreditarse el valor que se les asigna. En tal sentido es dable advertir que en el informe en cuestión el señor árbitro en forma precisa y detallada de la conducta indebida de señor Esquivel.

RESUELVE:

• Sancionar por el término de 3 (tres) meses al señor Manuel Esquivel, integrante del cuerpo técnico del Club Don Salvador. (cfr. art. 22 del RTP) 2) Dar por finalizado el encuentro con el resultado de planilla, al momento de haber sido suspendido. Independiente (4), Don Salvador (0). (cfr. Arts. 32, 33, 106 y 152 del RTP) 3) Archívese y publíquese.

Expte. Nº40/2016 Partido: DON SALVADOR vs INDEPENDIENTE (1º B), de fecha 03/09/16

VISTO: Que el Club Independiente presentó un escrito en dónde informa que había llegado a un acuerdo por los arreglos en el predio del Club Don Salvador. Pero éste último club en otro escrito dice todo lo contrario. Viendo que no han llegado a un acuerdo entre las partes.

RESUELVE:

1) Se intima al Club Independiente, para que antes del día 11/10/16 llegue a un acuerdo con el Club Don Salvador. Para ello deberán presentar un escrito en donde conste en lo que se compromete cada parte. Teniendo que ser firmado por los presidentes y secretario de cada Club. En el caso que esto no se cumplimente, se sancionará según reglamento al club infractor.

Expte. Nº42/2016 Partido: SAN LORENZO vs SANJUSTINO (FUTSAL), de fecha 19/09/16

VISTO: que el señor Bovadilla, con fecha 27/09/16 presentó un escrito haciendo uso del derecho a la defensa. CONSIDERANDO: Que el escrito presentado por la parte imputada, corresponde señalar, que las razones expuestas en el mismo no logran conmover los motivos tenidos en cuenta por este H.T.P., entre los cuales, cabe destacar que los informes arbítrales confeccionados constituyen semiplena prueba de lo que en ellos consignan y que solo mediante pruebas directas en contrario puede desacreditarse el valor que se les asigna. En tal sentido es dable advertir que en el informe en cuestión el señor árbitro en forma precisa y detallada de la conducta indebida de señor Bovadilla.

RESUELVE:

1) Sancionar por el término de 5 (cinco) años al señor Adrián Bovadilla, integrante del cuerpo técnico del Club San Lorenzo. (cfr. art. 22 del RTP)

2) Archívese y publíquese.
